Conditions of use of the www.liveriga.com portal

1. General conditions of use

1.1.  The conditions of use of the www.liveriga.com portal, hereafter in the text - the liveriga.com portal - define the terms and conditions of use of the services available at the liveriga.com portal, the restrictions placed on all of its users, as well as the sanctions which may be applied in the event that these are not observed.

1.2. Various services are offered to users of the liveriga.com portal, including access to new and up-to-date news and articles, the opportunity to take part in discussions and commentaries on the news items and articles published on the site, information on travel, flights and events, and a free exchange of information.

1.3. The information services provided through the liveriga.com portal are free of charge; the liveriga.com portal may offer separate pay services, and the services distributed or provided using the liveriga.com portal by partners of liveriga.com may also be provided for a fee.

1.4. Partners of liveriga.com themselves hold responsibility for the services they provide through the portal.

1.5. Any user of the Internet has the right to receive the internet services offered by the liveriga.com portal and mentioned in these conditions of use if this does not affect another person’s rights.

1.6. Registered users of the liveriga.com portal, who have created their own user account, will be able to use several other services, including pay content services, in addition to those services and opportunities which are available to unregistered users. Holders of a liveriga.com user account may create and use a free email account, exchange opinions, files and information with other users, and mark events and articles which are of interest to the user.

1.7. liveriga.com reserves the right the amend the conditions of use of the portal; amendments come into force with their publication on the liveriga.com portal.

2. Creation and deletion of liveriga.com user accounts

2.1. In order to become the holder of a liveriga.com user account (a registered user), a registration form should be filled in on the liveriga.com portal. liveriga.com do not verify the authenticity of information submitted by users; however, in the event that a user is found to be using another person’s personal details, liveriga.com has the right to delete the user’s account and notify the supervisory authorities of possible infringements of normative acts.

2.2. The user accepts not to reveal the access details to his/her liveriga.com account to another person. The user must inform liveriga.com without delay by sending an email to the Help Service email address feedback@liveriga.lv in the event that an account has been accessed without the user’s permission, or the user suspects that this could have happened.

2.3. The personal data of a liveriga.com user, such as name, surname, date of birth, address, and other personal information, if such has been submitted, shall not be divulged to any third person without the user’s agreement, except in cases foreseen by normative acts of the Republic of Latvia, if such data is requested by the investigative institutions of the Republic of Latvia.

2.4. In the event of a forgotten password, the user should send a request for password renewal to the liveriga.com help service through the portal’s authorisation window. An instruction on how to renew the password will be sent to the email address indicated on the registration form.

2.5. If a liveriga.com portal user has not used his/her user account or email address (using the provided liveriga.com email address and password for authorisation) for more than 180 days from the last date of authorisation on the portal, and where the user account contains no funds, the user account and free email account will be deleted, and with this the person’s personal information will also be deleted. In the event that a liveriga.com portal user has not used his/her user account or email address (using the provided email address and password for authorisation) for more than 12 months from the last date of authorisation on the portal, and where the user account contains funds, the user account and free email address will be deleted, and the funds present in the account will not be repaid.

2.6. If a user does not agree with the conditions of use of the liveriga.com portal and does not wish to further use the services of his/her liveriga.com user account, he/she may close the account by sending a corresponding request from the liveriga.com email address in question to the liveriga.com Help Service email address feedback@liveriga.lv. Upon receiving the said request for closure of the account, all of the user’s personal information will immediately be deleted from the database; if the user account contains funds, these will not be repaid to the user.

2.7. liveriga.com reserves the right to delete a user account without the user’s agreement if the user fails to observe the conditions of use of the liveriga.com portal. In such an event all of the user’s personal information will be deleted, including data from the user’s email account. If the user account contains funds, these will not be repaid.

3. Copyright and publication of materials and information

3.1. The liveriga.com user accepts that he/she is responsible for the information published by him/her on liveriga.com (including but not limited to sensitive materials, photographs, emails, comments, or the results of another person’s creative intellectual activity), hereafter referred to as materials, being lawfully acquired and within the user’s rights to be used in this way.

3.2. The user holds responsibility for consequences arising as a result of the publication, sending or posting of materials on the liveriga.com portal, including responsibility for each activity carried out on the liveriga.com portal as a result of which another person’s copyright is affected or could be affected.

3.3. On the liveriga.com portal it is prohibited to publish, post or send to another user material which is deemed by normative acts as unfit for publication, including but not limited to:
3.3.1. materials whose publishing or sending would result in the infringement or violation of the intellectual property rights of a third person;
3.3.2. materials which are injurious to a person’s honour or reputation, or are contrary to moral principles, including materials of a pornographic nature;
3.3.3. materials which promote violence, hate or the committing of other unlawful activities.

3.4. On noting the posting of materials mentioned under point 3.3, liveriga.com has the right to immediately delete those materials, also to delete the user account of the publisher of the materials and/or block further access to the liveriga.com portal, as well as to notify the supervisory institutions of the user’s illegal activity.

3.5. Users of the liveriga.com portal have the right to include links to other internet resources in their correspondence or comments on the portal.

3.6. The user of the liveriga.com portal grants liveriga.com the permission to use and publish materials submitted to the site, along with the author’s name, if this has been declared. The contributor of these materials has no right to demand copyright or other compensation from liveriga.com for the use of information contributed to the portal.

3.7. The user agrees that liveriga.com, in carrying out the necessary technical measures in order to provide services to its clients, has the right to forward and distribute materials on various public networks and information environments, and carry out any alterations to these materials which are necessary in order that these conform with the technical requirements of networks, equipment, services and media activities.

3.8. The liveriga.com portal accepts no responsibility for information republished by a user from other sources.

3.9. The materials posted on the liveriga.com portal are protected in accordance with the Copyright Law of the Republic of Latvia. Any republication of material published on the liveriga.com portal is permitted only where the republished text contains a reference to the liveriga.com portal.

3.10. Users of the liveriga.com portal may post information on the site for non-commercial purposes only; posting of commercial advertisements must be agreed with liveriga.com.

3.11. The poster of material on the liveriga.com portal confirms by the fact of posting this material that he/she is the author of the material or that he/she has the author’s permission to post those materials.

3.12. The poster of material is responsible for any claims regarding the posting arising from persons depicted in those materials and for claims related to violation of copyright or related rights.

3.13. The user of the liveriga.com portal agrees that liveriga.com may use free of charge photographs posted by the user on the site.

3.14. The liveriga.com portal retains the right in case of necessity to delete without prior warning materials posted on the site.

3.15. liveriga.com is not responsible for losses incurred in the event that a user account and its content, including files posted on the liveriga.com portal by the user, are deleted or partially damaged as a result of an unintentional action on the part of liveriga.com or in the event of malicious or unlawful activity by a third party.

4. Use of email accounts

4.1. The user accepts not to use a liveriga.com email account to sent files, data or information:

4.1.1. if such action is unlawful;
4.1.2. if doing so infringes on the copyright or related rights of a third party;
4.1.3. which are illegal, harmful, contain threats, contravene the norms of public morality, are offensive, slanderous, or otherwise damaging to a person’s honour and dignity;
4.1.4. which incite violence or promote ethnic, racial, religious, social, sexual, gender or any other kind of discrimination or hate;
4.1.5. which promote or advertise pornography;
4.1.6. which can be considered spam or unapproved advertising;
4.1.7. which are infected with a virus or were created to harm the operations or security of computer or telecommunications software;
4.1.8. which violate licensing agreements or promote their unsanctioned use, as well as distribute links to such information.

4.2. liveriga.com has the right to block incoming email from an email addressee if his/her action is or could be qualified as unlawful.

4.3. The incoming and outgoing email of a liveriga.com user email account is filtered with an anti-virus program and spam filter.

4.6. If liveriga.com suspects that a liveriga.com email account user is distributing spam, the user’s email address may be blocked for a certain time period. If repeated distribution of spam is noted from the user account, the user account and all data therein may be deleted.

4.7. liveriga.com does not monitor the content of emails sent and received by the user; this responsibility is held only by the user or by the sender of the email. However, liveriga.com has a duty to inform the supervisory institutions of any possible violations of normative acts committed by a service recipient, if such become known, as well as provide the supervisory institutions with any information requested on a service recipient.

4.8. liveriga.com is not responsible for costs or losses incurred by a user if such costs or losses have not arisen as a deliberate result of the actions of liveriga.com; liveriga.com is also not responsible for losses which arise as a result of the actions of a third party in the liveriga.com email system.
